Are all parcels required to abide by the LOD regulations?
Yes, all parcels are required to abide by the LOD regulations. However, certain parcels, which received certain governmental approval prior to the adoption of the LOD, such as a preliminary or record subdivision approval or site plan approval, are entitled to complete development in accord with such approvals provided such approvals are diligently pursued to completion. Nevertheless, once development as shown on such approval is completed, then all future changes to uses on the parcel must abide by the LOD regulations. Individuals that believe they are entitled to complete development in accord with a governmental approval granted prior to February 17, 2010 should write the Loudoun County Zoning Administrator for a vested rights determination.
