Are baggy pants and skateboards normal parts of adolescence, or do they adversely affect others quality of life?
While baggy pants, per say, are not a safety hazard, certainly skateboarders who use our streets and who become a hazard to traffic or a safety concern for drivers and are a legitimate concern for law enforcement. Likewise, skateboarders on public sidewalks could very easily be a safety concern for elderly citizens or pedestrians who otherwise would not expect to encounter a skateboarder. Legislation directed at baggy pants first needs to be constitutional so that deputies, if they are required to enforce same, know exactly how to determine a violation. If the intent of such legislation is to similar to those laws regarding indecent exposure, then the District Attorneys Office should be consulted prior to arrests or the issuance of summons regarding same. Certainly, some people are offended by this fad. However, as to whether or not it rises to a violation of the law, will depend upon the wording of the statute and the Courts interpretation of same.
