Are employers mandated by law to provide EEO and Sexual Harassment Prevention training?

0

The unequivocal message from the Supreme Court is that employers have a responsibility to create and maintain a workplace free of discrimination and harassment. While training is not mandated by the EEOC or NYS Human Rights Law, it may be directed under Executive Order or employer policy. At a minimum, organizations employing 15 or more people are required to have policies and inform staff of their rights and responsibilities regarding employment discrimination and workplace harassment. Employers demonstrating reasonable efforts to inform staff of expectations, prohibited behaviors, disciplinary actions and avenues of redress can substantially reduce – and often eliminate liability. Trends in case law show that training is the most effective way to impart this type of information. A well-written policy coupled with harassment prevention training can provide the first line of defense against a claim of discrimination or harassment.
