Are hate crime enhancements (extra punishments for the hate part) just or unjust?

I believe they are unjust and here is why. Take the Jena 6 case in LA. 6 african-american students beat the crap out of one white student for apparently making some racial comments. That was not a hate crime because it was against a white kid. Had it been 6 white kids attacking one black student, it would have been labeled a hate crime. I don’t think something that would be one sided can be called just. I am not a racist and am in no way saying abuse on any scale is ok. But, if there are hare crimes against African Americans, Homosexual Americans, Hispanic Americans, then the same should apply to German or Irish Americans too.
