Are people with HIV/AIDS, hepatitis or other communicable diseases covered?
Yes. The DDA definition of disability includes “the presence in the body of organisms causing disease or illness; or the presence in the body of organisms capable of causing disease or illness”. Section 48 of the DDA provides that it is not unlawful to take measures in relation to infectious diseases which are reasonably necessary to protect public health. This is not however a more general exclusion of people with infectious diseases from the protection of the DDA.
