12.1 The U.S. Supreme Court said there is no federal common law within states of the Union. See Erie Railroad Co. v. Tomkins, 304 U.S. 64 (1938). 12.2 The Rules of Decision Act, 28 U.S.C. 1652, says that the rules of decision within states of the Union are STATE law, not federal law.
