Maybe you should talk to bankruptcy attorney or financial experts about bankruptcy for this financial issues. They should be able to help you.

I won a judgement against my ex-wife on an overpayment of child support in “Family Court”. The amount was over 13K. I am in the process of garnishing her wages. I am afraid that she may file for bankruptcy rather than pay me a penny. My understanding is that child support owed cannot be discharged. Since this is an overpayment of child support that my ex-wife needs to pay back, does this debt also fall under as a non-dischargeable debt?
