Can a Clerical unit employee who is on an internship in a position outside of the bargaining unit receive the increases provided for in new labor agreement?
Yes. An employee on an internship is on an approved leave from his/her permanent position. Therefore, the employee is eligible for the lump sum and retroactive pay for any portion of paid employment that occurred in a Clerical unit title during the relevant pay periods as provided for in the labor agreement. Since merit increases are given in the permanent title, the employee is also eligible for a merit, assuming all other merit eligibility criteria are met. Furthermore, the salary for the employee’s permanent position would be adjusted according to the labor agreement terms, and the employee would have an adjusted salary upon return to the permanent position. Note: since the internship position is not in the bargaining unit, there is no requirement to adjust the internship salary as a consequence of the changes that are made to the Clerical unit position.
