Can a Fellow take clients with them when they change employer?
When Legal Executives change firms they cannot take clients with them. The client’s data belongs to the firm and not the Legal Executive. If they take the data they are breaching the Data Protection Act and client confidentiality. A Legal Executive cannot approach clients and ask them to leave the current firm and take their instructions to the new firm. The firm should contact clients and let them know the details of the fee earner taking over their case.
