Can a hazmat employee perform duties after expiration of training certificate?
The short answer is no. All hazmat employers are required to perform and meet the training requirements of 49 CFR Subpart H. This subpart stipulates that a hazmat employee must be recurrent trained within 3 years to perform hazmat duties. Someone performing duties in hazmat may find themselves in violation of Subpart H. Appendix A to Subpart D of Part 107 lists frequently cited violations; failure to provide recurrent training to hazmat employees required by 172.702 (general awareness, function-specific, safety, and security awareness training), is baseline assessed at $450 and up in each area.
