Can a married filipina remarry without having annulment or divorce in a foreign country?
Legally she cannot marry during her first marriage subsisting. The fact according to Indian Matrimonial laws regarding marriage between Indian citizen & foreign citizen outside India ,the Foreign Marriage Act,1969 clearly provides that both parties to marriage should be unmarried & both of you will be requiring proof of being unmarried or single or divorcee or widow/widower as the case may be. The unmarried or single status you both require & for that she will have to show/attach decree of annulment/divorce of her first marriage, even if she try concealing this fact of being already married, the Marriage Officer will ask for unmarried/single certificate issued from her country, the same will apply for you. You being India will get this in the form of Affidavit/statement on oath given by both your parents, duly attested by Notary/Magistrate from India.
