There are no technical reasons why the formerly wasted area around a fixed path cannot be used to serve the public interest with advanced nomadic or mobile services. However, the licensee of a Part 101-Fixed Microwave Services path can only deploy equipment that is FCC certified. Although the FCCs present rules allow for the design of paths with Concurrent Coordination capability and cover the technical requirements for fixed Subordinated path equipment, the present FCC rules do not adequately cover the technical requirements for Subordinated equipment for nomadic or mobile applications and a Petition for a Rulemaking is required. After a Petition for a Rulemaking is granted, equipment manufacturers could petition the FCC for an immediate waiver of the rules pending a rulemaking.
