Can I be refused my Annual Holiday from my Job as Kitchen Porter?

You should have signed a contract when accepting your job, which would have given details of holiday entitlement. Surely you have your copy? If you don’t have one, then you are employed illegally and it’s tough -you have no comeback. Verbal agreements have no place in law, unless you have witnesses. Even if you have a contract, if you are employed as a Chef, there may be an exclusion clause which prevents you from taking holidays during the Summer months (I would certainly put this in, if I was employing a Chef for the Summer!) If you have lost your copy of your contract, ask your employer to give you another. If he can’t produce it, threaten to report him to Trading Standards. Or if you’re here illegally, just run away and get another job….or go home.
