In the face of a continuing challenge from the Drug Enforcement Administration (DEA), makers of hemp foods have yet another legal hurdle to clear. The U.S. Court of Appeals for the Ninth Circuit has agreed to re-hear its decision that the DEA cannot ban foods containing hemp. At issue is a specific clause in the Controlled Substances Act that excludes hemp fiber, seed and oil, along with poppy seeds. Since these plant items are not psychoactive, the DEA cannot claim jurisdiction over them the same way it does marijuana or heroin. It is virtually impossible to fail a drug test for marijuana after eating hemp seeds or hemp oil, and comparatively easy to show a false positive for heroin or opium after eating poppy seeds. Yet the DEA does not target manufacturers of poppy seeds. June 5 was the original deadline for the Bush administration to appeal the Ninth Circuit ruling to the Supreme Court, but this deadline has now been extended by at least three months.
