They should give you a straight answer. The only weekness is how longer after you are out of arrears would they turn off the debt flag with FMS. As long as that flag is set, your refund will be offset.

You need to talk to them and ask them. It is only a state refund they take not federal. I would let them take it and get your amount owed paid down.
