An offence committed outside work may be ground for dismissal if it affects the suitability of the Employer/the Employee to continue in the type of work. If proper investigations do establish the facts of the case such as a criminal offence involving violence, dishonesty or a sexual offence it would be more likely to justify termination. A proper procedure would have to be followed up to and including the statutory disciplinary and dismissal procedure.
