Can salaried employees be entitled to overtime compensation?
Yes, but only if the salaried employee is nonexempt. If the company pays the nonexempt employee a salary, the employee is nonetheless entitled to one-and-one-half times his or her regular rate of pay (i.e., time-and-a-half) for the number of hours that exceed the 40-hour work week. To compute this, the company must determine the employees hourly rate (usually by dividing the number of hours worked into the salary). However, if the employee is exempt, no overtime compensation is required under the FLSA.
