Can someone be evicted the person filing the eviction papers doesn have sole custody of the house?

To the best of my understanding, the only person or company that can legally evict a person from a house or apartment in the United States is the person or company that owns the house or apartment or from which you are subletting the house or apartment. It sounds to me like you need to talk with a lawyer as soon as possible. Most cities in the US have tenants’ rights organizations who can help you with these kind of legal matters even if you cannot afford to hire a lawyer at standard rates.
