Can Somerfield be blamed for his death?
While it is tragic, I think its absolutely rediculous that the parents are trying to shift the blame from themselves onto Somerfield! We have all at least once as a child swung on a railing, even tho they are not meant for that purpose. In my opinion the store was not negligent, it was the parents! If the child had hurt themselves on a childrens play area then there might be some case. but Somerfield bars and railings are not meant for playing on and if a parent chooses to allow its child to play on it then thats their responsibility. I doubt the parent was next to the child watching it on the bars. More likely the parent had allowed the child to run off. The parents should have had more control over their child. If they’re going to let a FOUR yr old run off and mess about then no one else is responsible!!!!!!!!
