Can the funds be distributed from the HSA if they are mistakenly put in the wrong account?
Every account has a non-forfeitable interest in his or her HSA. The answer would depend on all of the facts and circumstances. If the trustee did not follow the employer’s instructions, that would be a very different situation, and easier to answer, than where the employer is actually responsible. Perhaps reducing a future contribution would be a better solution than distributing money from an individual’s account.
