You made 3 MAJOR MISTAKES. 1. You didn’t interview agents to see how they would sell your house. She is “only” trying to sell your house. However, she needs to be MARKETING YOUR HOUSE to make it stand out from the other houses. Putting an ad in the paper and using the MRIS is NOT, NOT, NOT marketing. 2. You picked an agent that is out of town, doesn’t know your market, doesn’t have buyers for your home and has to drive, just to show the place. This was Dumb!!! Real estate is local! 3. You signed a year agreement. You should NEVER sign for more the 3 months. At the end of the 3rd month, you have the option to continue or end the contract if you feel that job isn’t being done. I would talk with this agent AND HER BROKER (her boss) and explain that you want out now or within the next month.

The broker can release the contract, but its not guaranteed You need to start documentation, your dissatisfaction with the agents advertising, then take your complaint to her broker seeking for them to advertise more or insist to be released or you will pursue the matter upward but you need first to place the agent on notice that her current service is not what was implied to you by her real estate firm, and your dissatisfied, then take it up with the broker,

Depends. READ your contract, carefully. It is a binding contract and she has expended money in advertising, and time and effort in marketing your home. It’s a LOUSY home sale market. Probably you’re overpriced if there is no one looking at your home and you’re in the MLS. HOWEVER, most brokers will allow you out of a contract, upon written notice, even though they don’t have to. You CANNOT drop her services without getting this contract dissolved. And I’d suggest you owe her something, a nice giftcard, for her letting you out of contract, and for the services she has rendered.
