Do Gays and Lesbians have Marriage rights under the law?
This is a difficult question to answer fully. Specifically, no, there is no way for Ohio residents to create a marriage relationship which this state would recognize officially at the present time. The Anti-gay amendment to the Ohio Constitution is presently working its way through the courts. It would appear that gays, lesbians, bisexuals, and trans-gendered individuals would be able to avail themselves of many types of legal benefit. They could make powers of attorney or wills which “should” be respected by the courts, but until the amendment is fully litigated in both the Ohio and Federal courts, specific, hands on legal advice is necessary for the GLBT and otherwise single community. In short, if you have property you need an attorney now more than ever.
