In some states, Lemon Law protections apply only to drivers who have purchased new cars; in Texas, however, used cars are covered under the Lemon Law as long as they are still under the manufacturer’s original warranty or the problem started when the vehicle was still under warranty. Unfortunately, used cars that are covered by an extended service contract are not eligible for Lemon Law protection. Demonstrator vehicles are considered new cars for the purpose of the Texas lemon law. When considering whether or not you should file a Lemon Law claim, remember that a vehicle must have a serious defect that has been unable to be repaired in order to be considered a lemon car. The defect must be something that an experienced auto repair mechanic would say substantially impairs use or market value, possibly creating a safety hazard.
