Does a company need to be licensed in order to conduct background investigations in Montana?
In a written decision, dated July 2, 2004, the Montana Department of Labor and Industry’s Office of Legal Services addressed this issue. They stated that “It is the Board’s opinion that when an entity is in the business of performing these services [pre-employment background investigations] for any consideration whatsoever within Montana, the individuals employed by the entity and performing the above-described services must apply for and obtain licensure as private investigators”.
