Does an unmarried father have the right to see its child if the mother goes for child maintenence?
If he is not named on the birth certificate, then he is not legally the father and has no legal rights where the child is concerned. He must file in court for visitation. The first step would be to prove paternity, which would entail a DNA test. After he’s proved paternity, he could ask for visitation, or even joint custody. See an attorney.
As far as I know, unmarried partners have NO rights.(laws may be different now) But you will have problems claiming child maintenance if he is not on the birth certificate. Unless he was abusive or otherwise, don’t just cut him off because your p****ed off with him, he will always be ( if indeed he is) their father.
