Does anyone know of any other assault or battery cases where consent was an issue?
There is also R v Slingsby (1995) a man fisted a woman (conseually, though this is extremely painful and can cause injury) and accidentally killed her due to the lacerations from a ring he forgot to take off. Consent was ruled a defense in this case. Brown remains HIGHLY contentious to this day due to the comparative bias against the homosexual men (where consent was ruled not a defense) compared to the 3 other cases that all involved heterosexual couples (where consent was ruled to be a defense). As a mental health professional, I do often have to weigh “consent” in the context of what may be a person who is mentally ill. Sexually Sadism and Sexual Masochism are both considered mental illness under the DSM-IV-TR, and there can be such a thing as “false consent” where a person by reason of mental defect or some sort of impairment cannot render true informed consent, no matter how they seem to behave in the moment.
