Does the stimulus package allow whistleblowers to collect some of the enforcement penalties?
Yes. The stimulus package stipulates that civil penalties collected should be used to fund the Office for Civil Rights (the HIPAA privacy enforcement agency) and by January 2012, the HHS secretary must establish a method by which individuals (whistleblowers) would receive a percentage of the penalties collected.
