Sworn testimony is subject to cross-examination by the parties but only sworn testimony is considered as evidence that the Superintendent of Insurance may use as a basis for a decision. Written public comment is considered unsworn testimony unless it is notarized as sworn testimony. In addition, if you want notarized testimony to be treated as evidence, you must be available for cross-examination during the public hearing.
