I would suggest that when you consult with an attorney you discuss the possibility of temporary custody by an extended family member under Chapter 751, Florida Statues. If both parents consent to temporary custody to you, you may initiate your own suit for temporary custody. The parents will need to provide written consents to temporary custody. If father does not consent, you will need to prove he is an unfit parent. For example, if the father has abandoned the child, this may be enough. If you are granted temporary custody under Chapter 751, you will not need to obtain the consent of either parent as you would pursuant to a guardianship as described in the previous answer. In addition, you may include a request for child support in your petition for temporary custody.
