As you already have a solicitor you should be following his advice not asking on here. He knows all the facts of your case, and he is a qualified professional for whom this should be a straightforward problem to resolve. I hope your solicitor has already thought of / done all this, but my advice would be this: Firstly, are you absolutely sure your house is not registered? The registration system was first introduced in 1926 and phased in gradually. It finally went nationwide in 1990. If it has been sold or re-mortgaged since then it will definitely be registered. It could be registered (depending where it is) even if the last transaction was much earlier. You can easily check your address with the Land Registry to check. If its definitely not registered then there will be some deeds. Generally a bank or building society will only hold the deeds while your mortgage is outstanding.
