How does AHRC assess whether facilities are complying with the AHR Act and its regulations?
The primary objective of AHRC’s compliance strategy is to protect and promote the health, safety and values of Canadians by encouraging and facilitating compliance with the AHR Act and its regulations. It is based on a cooperative approach involving clinics, physicians and other organizations within the Government of Canada. When AHRC raises the possibility of non-compliance, it is the responsibility of the facility to take timely and appropriate action to comply with legislative and regulatory requirements. AHRC will clarify what is required to achieve compliance, but will not dictate how it must be achieved. AHRC’s compliance strategy foresees a graduated series of interventions and measures that take into account different factors, such as the seriousness of the breach. For example, in some cases the Agency might provide the facility with guidelines to assist in compliance with the regulations; in other cases the Agency might refer the matter to the RCMP for criminal investigation.
