The answers from sharpfirm are excellent, and with some "laymen’s clarity, additional information may be helpful, it not essential.  One claim number is assigned for personal injury and for property damage.  Most insurance companies use two separate adjusters for each catagory.  The case value for personal injury is generally assessed by the total amount of medical charges incurred for treatment for the victim.  Additional variables, such as out-of-pocket costs for prescriptions, and any payments made to medical providers prior to the settlement can be added to the total.  A good rule of thumb to help someone calculate the pain and suffering money awarded for negotiated settlements are 3 times the total cost of medical.  So if someones medical cost are $3000, most lawyers would demand a miminum of $9000.  From these proceeds, 1/3 would go for medical costs, 1/3 for legal fees and 1/3 awarded to the victim.  The pain and suffering money paid to victim is also tax exempt. It’s important to note that any attorney who can negotiate three times the cost of medical would be considered the "gold standard" in recovery’s.  Also, these guidelines are based on TN cases and may vary from state to state.
