How is a real estate tax refund obtained following a successful real estate tax appeal?

For taxpayers entitled to a refund, a refund application must be made to all jurisdictions that levied taxes based on the assessment that was reduced. The taxing jurisdiction typically requires proof of payment of the tax to be refunded, often in the form of an affidavit and an agreement by the taxpayer to indemnify the taxing jurisdiction against others who may claim to have paid the tax. Interest on the refund from the date of the payment of the tax to the date of the final order correcting the assessment is available for orders granted after trial, and also on settlements in which the taxing jurisdiction agrees to pay interest. New York City does not pay interest on settlements correcting assessments. The refund check, made payable to the taxpayer, is delivered by the taxing jurisdiction to the real estate tax attorney of record on the assessment appeal.
