Petition validity varies according to the type of petition filed. Fiancée (K) petitions are valid for four months. Family-based, immediate relative, and employment-based petitions are subject to the Termination of Registration rule. The rule states that in accordance with Section 203(g) of the Immigration and Nationality Act, an applicant’s registration for an immigrant visa shall be terminated if, within one year after transmission of a notification of the availability of an immigrant visa, the applicant fails to apply for an immigrant visa.
