A hearing will normally occur within 45 days after selection of the arbitrator. The arbitration process will be conducted in accordance with the published Rules of the LDR Program, available for download on this website. A prehearing conference may be scheduled by the arbitrator in order to define and narrow the issues for hearing, set hearing dates and a hearing location, and take any other steps necessary or appropriate to expedite the arbitration process. Arbitration hearings will be conducted at a place convenient to the parties. All witnesses at hearing will testify under oath or affirmation. Witnesses and documents may be subpoenaed, and exhibits may be received in evidence by the arbitrator. The arbitrator has the power to sequester any non-party witness during the testimony of other witnesses.
