If the trial court approves the settlement as fair and reasonable, the governing law in the Seventh Circuit Court of Appeals requires the trial court to determine the attorneys fee by doing the courts best to estimate the terms of the contract that private plaintiffs would have negotiated with their lawyers, had bargaining occurred at the outset of the case when the risk of loss still existed.
