If Consultations begin but are not concluded within 40 days regardless of cause, does the process end at the 40-day limit with whatever is in place at the time?

May 26, 2009: Yes, the consultation must conclude within 40 days. If the consulting agencies have not made recommendations during the 40-day consultation period the requirement to consult is waived and the COGCC Director shall consider the operator’s application on the basis of the materials submitted by the operator.
