First a C&D letter is not a preresiquite as to if they sue you or not. That is even if you don’t send one they may or may not sue you. Or if you do send one they may or may not sue you. Yes with some creditors once you send that they will file a suit, but that is really up to the creditor. Some may sue, but others will just sell your debt to another collection agency. Now, with all of that said even if they do file suit against you. It will probably take anywhere from 1-3 months to get your case heard and the garnishment put in place. Just as there are no absolutes with what a creditor will do, the time for this is going to be dependent on the backlog of your local court.
