If the Commission cannot remove the sheriff from office, can the Commission remove the sheriffs name from the upcoming general election ballot?
No. The Commission does not have the authority to omit or remove a candidate’s name from the ballot. However, if a candidate is convicted of the crime of violating Section 106.19, Florida Statutes, his name may be omitted. State attorneys, not the Commission, prosecute criminal violations of The Florida Election Code. See2006->Ch0106->Section%2018#0106.18″> Section 106.18, Florida Statutes.
