In a nutshell, what does the Horticulture Code do?
The Code has six parts as shown in the diagram. Part 1 outlines the purpose of the Code and defines some of the important terms used in it. Part 2 describes the responsibilities of a trader to prepare, publish and make available a trader’s terms of trade document. Part 2 also outlines information that must be included in a trader’s terms of trade document. Part 3 requires that a trader and a grower enter into a written horticulture produce agreement before they can trade in horticulture produce with each other. It also sets out other requirements and obligations relating to horticulture produce agreements, including information that the agreement must contain. Part 4 sets out the general rights and responsibilities of growers and traders. It also outlines the specific duties that apply to agents and to merchants.
