Yes, when a Bail Agency post a Bail Bond with the Jail or Court, the Bail Agency is taking responsibility for the defendant to appear at all future court dates. For example, if a defendant does not follow the terms and conditions of the Bail Agency, then he/she risk being returned to jail! Apollo Bail Bonds provides the comforts of not being in a jail cell. Is a defendant released on bail really in the custody of the posting Bail Agency?

Well, "custody" is a strong word. The defendant who has been bailed out, say on Los Angeles Bail Bonds, is out of jail because the person who signed for them and the bail bonds company. These two entities are responsible for the defendant.

"Responsible" has a different feel than the word "custody". But essentially, yes, the bail bonds company is responsible for the individual that they bailed out of the Los Angeles Jail.

The person who is initially responsible for the defendant is the indemnitor. This is the person who actually signed the bail bonds papers. This is the person who most likely put up the bail bonds premium for the bond.

If the defendant does not make any of their court dates, the bail bonds company first calls the defendant and all the numbers they gave to the bail bonds agents. Then, if there is no answer for any of the defendant's phone numbers, the bail bonds agents call the indemnitor who is essentially responsible for the defendant's whereabouts.

If the defendant does not make a court date, the courts file paperwork and alert the bail bonds company. Then the bail bonds company starts making the calls. So in essence, the courts kind of see the bail bonds company as being responsible and then the responsibilities move on down the chain from there.

If the defendant was bailed out what is called "cash bail", then the responsibility falls a bit differently. A bail bonds company is not involved because the defendant was bailed out entirely on cash put up by either himself or by an indemnitor. A cash bail is when someone shows up and bails the defendant out by putting down the entire bail amount in cash or money order. They then receive the money back when the defendant makes all of their court dates.

At this point, the person responsible for the defendant when cash bail is posted is the indemnitor, the person who signed for the defendant.
