Is an employee required to use all of his/her accrued sick leave before he/she is entitled to receive workers compensation benefits?

A. Yes. In accordance with the Texas Workers’ Compensation Act, if an employee elects to use paid leave, they must first EXHAUST ALL ACCRUED SICK LEAVE. Once sick leave is exhausted, the employee may then choose to use one or more weeks of other paid leave in lieu or receiving Temporary Income Benefits or be placed on leave of absence.
