Is it envisaged that the exceptional circumstances referred to in paragraph 4.4.69 may relate to circumstances which affect a Bidders ability to participate in a Round?
Paragraph 4.4.69 of the Notice will only be used in exceptional circumstances and the nature of these kinds of circumstances is such that it is not possible to specify them in advance. It would be for the Secretary of State to determine at the time whether or not to apply paragraph 4.4.69 when circumstances affected a Bidder’s ability to bid. However, it is expected that the Secretary of State would take into account the disruption to all bidders if a round were abandoned. If an emergency arises at a Bidder’s location the Bidder may try to contact the auctioneer on one of the numbers referred to in 4.2.2(c) of the Notice, e.g. by mobile telephone. 49: It appears from the guidance provided in the Information Memorandum that Authorised Officers do not participate in the auction process other than to sign the Bidder Compliance Certificate and the Bidder Association Certificate.
