Is it legal to take back a gift due to relationship issues?
Filing a false report to the police and their credit card company (claiming fraud when there was none) is pretty easy to detect and will cause them a world of hurt. Fines, screwed credit rating, etc. My guess is they won’t make good on the threat, and if they even tried, all the warnings about filing a false report would make them think twice. Keep the gift or don’t. It’s completely up to you. Legally, it doesn’t matter what you do — the gift was a gift, and except for engagement rings, gifts in relationships don’t carry implied contracts for staying together. When the relationship tanks, the keeping and returning of presents is mostly up to the individuals. There are exceptions like engagement rings, as I said, or family heirlooms and such, but if this is more like a Wii, then it’s yours to do what you want with it.
