Is the Calgary Board of Education allowed to set its own fee schedule for records requested under the Act?
The Act permits the Calgary Board of Education, by bylaw, Board resolution or other legal instrument, to set the fee schedule that may apply to FOIP requests. The Calgary Board of Education must comply with the FOIP fee schedule and may not charge more than the maximum amounts set out in the Regulations. The Calgary Board of Education has ratified by resolution the fee schedule as set out in the FOIP Regulations. The Calgary Board of Education may charge fees for requests for general information only for the following categories of services (a) locating, retrieving and reproducing the record; (b) preparing and handling the record for disclosure; (c) supervising the examination of the record; (d) shipping a record or a copy of the record; and (e) providing a copy of the record. Only photocopying charges apply to requests for personal information when the copies are in excess of 40 pages. Fees may be waived if the records relate to a matter of public interest.
