Is there has been in the last days/mounthes new cases in subject of juvenile/under-age arrest?
Answer Dear Hilla: There are, unfortunately, constant arrests of young offenders and suspects. The case most in the news is Roper v. Simmons, which is a death penalty case from Missouri, involving a murderer who was 17 when he committed the capital murder. The case has been accepted by the US Supreme Court to consider, again, the constitutionality of 16-17 year old murderers being eligible for the death penalty. Personally, I believe that some 16-17 year olds should be eligible for death. The standard areguements against making them eligible for the death penalty are quite weak, see below. However, I don’t think that those basic arguments will come into the final decison. I think the decison will be based on the evolving standards issue.
