May a church or religious organization operate an open-enrollment charter school?
Churches and other faith-based organizations exempt from taxation under Section 501(c)(3) of the Internal Revenue Code may apply for an open-enrollment charter. If the SBOE selects one of these applications, however, the applicant will be required to establish a separate nonsectarian organization exempt from taxation under Section 501(c)(3) of the Internal Revenue Code to hold the charter as Texas public funds may not be paid to a sectarian organization.
