May a laboratory that is managed by a university but located in a public building opt into Subpart K?
No. In order for a laboratory to be eligible to opt into Subpart K it must be owned by an eligible academic entity (see 40 CFR 262.200). Therefore, a laboratory that is managed by a university but located in a public building would not be eligible to opt into Subpart K (unless the owner of the public building is also an eligible academic entity that opts into Subpart K).
