In respect to workers’ compensation and unemployment cases, but for the work injury or unemployment claimant would remain employable. The disability standards for adults is an inability to engage in any substantial gainful activity by reason of a medically determinable physical and/ or mental impairment which can be expected to last for a continuous period of not less than 12 months or result in death. Other, often private, disability policies may be received, but could render a claimant ineligible for SSI (due to the aforementioned income requirements). Private policies often “offset” SSDI benefits so that a claimant may not receive more than the total amount of the largest award.
