My case was commenced prior to December 31, 2004 and is subject to Rule 77 case management. Must I comply with the time periods for mediation under Rule 24.1?
Yes. Rule 24.1 applies to cases that are subject to Rule 77 case management. Where the plaintiff fails to file a notice (Form 24.1A) stating the mediator’s name and date of the mediation session within the time prescribed in Rule 24.1, the local mediation coordinator will assign a roster mediator, pursuant to subrule 24.1.09. Parties, however, may continue to seek an order to extend the time periods in Rule 24.1.
